Child-Focused Courts to roll out across England and Wales

Families involved in child arrangements cases in Cheshire & Merseyside are set to see an important change in the way the Family Court handles private children matters. The Government has announced the wider roll-out of the Child Focused Model, previously known as the Private Law Pathfinder, and Cheshire & Merseyside is one of the next court areas due to implement it over the coming year. 

The aim of the new model is to make the court process more child-centred, more joined-up, and better at identifying risk at an earlier stage, particularly in cases where there are concerns about domestic abuse or other harm.

Rather than relying on multiple hearings to gradually build a picture, the court will place greater emphasis on early information gathering, early risk identification and understanding the child’s lived experience from the outset. 

A key feature of the model is the Child Impact Report. This is designed to help the court understand at an early stage how the dispute is affecting the child, so the case can focus more quickly on what arrangements are safe and in the child’s best interests.

The wider reform is intended to improve the experience and outcomes for families in private law children proceedings. The model has already been active in 10 of the 43 court areas across England and Wales as part of a pilot that launched in 2022, and evidence suggests cases have been resolved up to seven and a half months faster, with fewer cases returning to court after orders are made. 

The Government also says the model has helped reduce backlogs in pilot areas and improve the support available to victims of domestic abuse, including through Independent Domestic Violence Advisers.

For many families, this should be a positive step. If concerns are identified earlier and the court has better information sooner, decisions may be made more safely and more quickly. This may also help reduce the emotional strain that can come with a long-running dispute, especially where children are caught in the middle.
