What is remortgage conveyancing?

Remortgage conveyancing is the legal work involved when you replace your current mortgage with a new one, or taking out a mortgage on an unencumbered property you already own.

Although you are not buying or selling the property, there is still important legal work to be done. Your solicitor will need to act for you and, in many cases, also for your new lender. This includes checking the title to the property, dealing with the lender’s requirements, arranging for the existing mortgage to be redeemed and making sure the new mortgage is registered correctly.

The remortgage process

1. Instruction and file opening

Once you instruct us, we open your file, provide your quote and request the information we need to begin. This allows us to understand the property, your current mortgage position and any lender-specific requirements at an early stage.

2. Title review and lender requirements

We review the legal title to your property and work through the requirements set by your new lender. This may involve checking that the title is in order and making sure any conditions that must be satisfied before completion are dealt with properly.

3. Mortgage redemption figures

We obtain details of the amount needed to repay your existing mortgage and prepare for completion. This helps ensure that the current loan can be cleared in full once the remortgage goes ahead.

4. Completion of the remortgage

On completion, your existing mortgage is repaid and the new mortgage takes effect. At that stage, the new lending arrangements are put in place and the remortgage is legally completed.

5. Post-completion registration

After completion, we deal with the Land Registry formalities to ensure the new lender’s charge is registered correctly against the property. This is an important final step in completing the remortgage process.
