1. Continuous Lawful Residence

You must have completed the qualifying time on an eligible visa route. This qualifying time may differ depending on your route into the UK, however for most people this is 5 years on a qualifying visa.

2. Absence Limits

Most routes require you to show:

No more than 180 days per year abroad (5-year routes)
Long residence: 540 days in 10 years, plus additional rules

3. Knowledge of Language and Life in the UK

Applicants are required to pass a Life in the UK test. The Life in the UK test must be booked via the official government website only and costs £50. You can book your Life in the UK test here.

Applicants must demonstrate good character. This means no serious criminal convictions, deception, unpaid NHS debt, or serious immigration breaches.

What If My ILR Application is Refused?

If your application for ILR has been refused, you will receive a refusal letter from the Home Office which will explain their decision. This letter should let you know whether you have the right to a Judicial Review, or whether you need to submit a new application.

Whether you make the decision to move forward with a Judicial Review or submit a new application, both routes mean spending more money. The Judicial Review route is expensive and complex and if you win, the Home Office will be forced to revaluate your application. The risk is that they could still decide to refuse your application.
