Success in acquiring a UK spouse visa (commonly referred to as a UK partner visa), means that you will be able to join your British or settled spouse/partner in the UK without restrictions during the visa period, which is normally 2 years and 9 months for the first grant. What Is a UK Spouse Visa? 

A UK spouse visa (also known as a UK partner visa) allows non-British partners of British citizens or settled persons to live and work in the UK. It is part of the UK Family Immigration Route under Appendix FM of the Immigration Rules. 

The sole purpose of the spouse visa is to keep families together. It not only allows a non-British citizen the right to live and work in the UK, but it also provides a clear route to permanent residence here in the UK. 

To qualify, you must prove your relationship is genuine, meet the financial and English language requirements, and intend to live permanently together in the UK. 

Once granted, a UK spouse visa allows you to: 

  • Live in the UK with your partner for 2 years and 9 months (first visa period). 
  • Work and study without restrictions. 
  • Access NHS healthcare after paying the Immigration Health Surcharge (IHS). 
  • Travel in and out of the UK freely during the visa validity. 
  • Apply to extend your visa for another 2 years and 6 months, leading to Indefinite Leave to Remain (ILR) after 5 years of residence. 

Who Is Eligible to Apply for a UK Spouse Visa? 

Eligibility to apply for a UK spouse or partner visa depends on a number of factors, including how long you have been with your partner, your partner’s citizenship or settled status, and your financial situation. 

You can apply for a UK spouse visa if you: 

  • Are married to, in a civil partnership with, or have lived with a British citizen or person with settled or pre-settled status for at least two years. 
  • Intend to live together permanently in the UK. 
  • Meet the spouse visa UK requirements for income, accommodation, and English language. 
  • Are at least 18 years old. 
  • Can provide evidence that your relationship is genuine and subsisting.

UK Spouse Visa Requirements 

To be successful in your application for a UK spouse visa, you’ll need to meet several key Home Office requirements and provide supporting evidence. The requirements include: 

1. Relationship Requirement 

You must prove your relationship is real and ongoing, typically through: 

  • Marriage or civil partnership certificates 
  • Shared financial responsibilities (bills, tenancy, bank accounts) 
  • Photos, messages, and travel evidence 

2. Financial Requirement 

To sponsor a partner, the British or settled spouse must show a minimum income of £29,000 per year (as of April 2024, rising from £18,600). Alternatively, savings of at least £88,500 can be used if income is below that level. This is to prove that you can support yourselves without claiming public funds. 

This money can come from employment, self-employment, pensions, or other eligible sources. 

3. Accommodation Requirement 

You’ll need suitable accommodation for you, your partner and any dependants that’s not overcrowded and meets UK housing standards. You will not have access to public housing in your own right on a UK spouse visa due to the visa’s ‘No Recourse to Public Funds’ condition. 

4. English Language Requirement 

Applicants must prove they can speak and understand English at CEFR Level A1 (for the first application), through: 

  • A Home Office–approved English test, or 
  • A degree taught in English, or 
  • Being a citizen of a majority English-speaking country (like the USA, Canada, Australia, etc.). 

If you require an English language test, the cost is typically around £150 and must be booked with a Home Office approved provider.

Step-by-Step Application Process 

Initial Consultation & Eligibility Assessment

Document Preparation & Review 

We work with you to gather and review the required evidence. We will provide an evidence checklist and any examples or templates that might be helpful and once the evidence is gathered we will complete a review to ensure you have everything you need in the correct formats. 

Online Application Submission 

Your dedicated immigration lawyer will prepare and submit the application. We will also upload all documentation on your behalf to ensure that everything is completed as it needs to be to reduce the risk of rejection. 

Biometrics Appointment 

Once you have submitted the application, you will be required to attend a UKVCAS appointment (or a VAC appointment if you are outside the UK) where you will need to provide your biometric information. You’ll provide fingerprints and photos at the appointment and must take your passport with you. This is a mandatory step and allows the Home Office to confirm you are who you say you are. We will book this appointment for you and ensure all required documents are submitted electronically prior to your appointment to make this process as easy as possible. 

Decision & Visa Grant 

Standard decisions are expected to take around 12 weeks if you are outside of the UK, or 8 weeks if you are inside of the UK. If you are successful in your application and you are outside of the UK, you will need to collect your entry vignette and follow eVisa/BRP instructions after you arrive in the UK. Your entry vignette is a secure visa label issued by the UK Home Office via the Visa Application Centre (VAC) which allows you to enter the UK legally for the first time.  

If you are in the UK and are successful in renewing your UK spouse visa, you will receive a new leave/eVisa.

What If My UK Spouse Visa Application Is Rejected? 

If your UK spouse visa has been rejected or refused, you will receive a refusal letter from the UK Home Office outlining their decision and the reason(s) they refused, citing the specific parts of the Immigration Rules that were not met. 

Some of the most common reasons for a refused applications include your relationship not being accepted as ‘genuine and subsisting’, the financial requirements not being met, inadequate accommodation and incomplete or inconsistent information. This is why it is absolutely crucial that you have the correct evidence to be able to show that you meet all of the Home Office’s requirements. 

A rejection at this stage can understandably feel incredibly disappointing, but you do have options. 

Most spouse visa refusals include a right of appeal under Section 82 of the Nationality, Immigration and Asylum Act 2002 on human rights (Article 8) grounds, your right to family life. 

You can appeal if the Home Office’s decision breaches your human rights (e.g., separating you from your British spouse). To make an appeal you must: 

  • Submit your appeal within 28 days if you applied from outside the UK, or 
  • Within 14 days if you applied inside the UK. 

How Does the UK Spouse Visa Appeal Process Work? 

  • File an appeal online via the First-tier Tribunal (Immigration and Asylum Chamber). 
  • Pay the fee (£80 for a paper appeal or £140 for an oral hearing). 
  • Consult with your solicitor to submit appeal grounds, evidence, and witness statements. 
  • A judge will then review your case, sometimes with a hearing. 

If your appeal is successful, the judge overturns the Home Office’s decision and the visa is granted.
