When family circumstances change, understanding how to protect your children and put safe and positive arrangements in place for them is crucial to helping you make those often-difficult decisions.
We help our clients to approach arrangements for children constructively, without having to go to Court in the majority of cases.
If we do need to go through Court, we can provide clear advice and options and support you every step of the way with a cost solution that is right for you.
We can help advise you on: -
Parental Responsibility - Parental responsibility is a legal term that means you have specific rights and duties relating to your child(ren)s’ upbringing. It can only be bestowed on others in a number of specific circumstances. We can advise you on who has it, what rights and duties it bestows, and if, when and how it can be used. It does not mean you have a right to spend time with your child, but it does mean anyone with parental responsibility can be included when making key decisions about their children's lives.
Voluntary Parenting Agreements - We can also advise on specific issues regarding a child’s upbringing, such as where they should go to school, passport issues, schooling, religious disputes, or name change and taking or dealing with prohibitive action too, (e.g. such as relocating)
Child Maintenance Payments - Whether voluntary, through the CMS (Child Maintenance Service) or by way of Child Maintenance Orders we can provide advice and also assist with enforcement if agreements are not adhered to.
Child Arrangements Orders - Where children will live and who they should have contact with.
Specific Issue Orders - To make a specific decision about a child’s upbringing, such as where they should go to school
Prohibited Steps Orders– to prevent someone with Parental Responsibility making a particular decision in relation to a child, such as relocating.
When it comes to children matters, we give clear and straight- talking advice about your individual circumstances and what you can expect. We will discuss with you a range of options that are best suited to your evolving Family’s needs and discuss with you the best forum for resolution such as Mediation, negotiation or Court application.
