With an estimated 19.5 million families living together in the UK in 2023, over 17% of those were made up of cohabiting families. The law treats the cohabiting family differently when it comes to separation compared to those going through divorce. Although the law dealing with separating cohabiting couples is under review it is yet to ‘catch up’ when it comes to the reality of the modern family household.

 

We can:

  • Advise on financial applications for children for separating families, as well as advising when it comes to Child Maintenance issues as well.

     

  • Advise how to address any property disputes in all circumstances, including whether your name is on the property or not, how to protect any property, how bills should be met before resolution and matters relating to rights of occupation. We look at all the options to help you address any issues, including non-court resolution first. Although, where property disputes cannot be resolved amicably, we will advise on applications that can be made to the Court under the Trusts of Land and Appointment of Trustees Act 1996 in relation to applying for an order for sale and a declaration of your interest in a property.

     

  • Help when it comes to any other financial worries that you may have as a result of the cohabitation, including joint investments, endowment policies, other property that either party may have and debts and loans that may have been incurred either in joint or individual names.

 

  • Provide advice about Separation Agreements and Separation Deeds setting out details of any settlement terms reached.
